The driver of a car involved in an Aug. 4 traffic accident that resulted in the death of a Fort Wayne man was under the influence of marijuana at the time of the accident, according to police.
Results of a urine test taken the day of the accident from Michael R. Wiggins, 21, of EMS W26 Lane, North Webster, indicate the presence of marijuana metabolites.
Terry L. Wilson, 41, of Fort Wayne, suffered head injuries in the 1:53 p.m. accident on Ind. 13, south of Channel Street, in North Webster. Wilson was airlifted from the scene to Parkview Hospital, Fort Wayne, where he died at 7:31 p.m. that day.
A passenger on Wilson's motorcycle, Dennis Wilson, 11, of Chesapeake, Va., suffered a broken leg and was treated at Kosciusko Community Hospital, Warsaw. The younger Wilson is the nephew of Terry Wilson.
Wiggins suffered cuts and abrasions in the accident and also was taken to KCH.
An accident report indicates that Wiggins made a left-hand turn in front of Wilson, whose motorcycle struck the passenger side front portion of Wiggins' car. Both of the Wilsons were ejected from the motorcycle on impact.
As a result of the investigation, an affidavit of probable cause was prepared by the Kosciusko County Sheriff's Department and forwarded to the prosecutor's office for review.
The charges being considered are: driving while intoxicated causing death, a Class C felony; driving while intoxicated causing serious bodily injury, a Class D felony; driving while intoxicated, a Class A misdemeanor; and driving while intoxicated per se with a controlled substance, a Class C misdemeanor.
