“Dr.” Magiera’s letter shows a lack of understanding of the Constitution. I guess he never checked with George Washington, the “father of our country,” when Washington ordered the vaccination of the Continental army for smallpox?

“Dr.” Magiera should read the landmark ruling from 1905, Jacobson versus Massachusetts, a ruling that was recently cited in the Indiana University Vaccine mandate case. Jacobson has been cited in numerous cases relating to health mandates for well over 100 years. For “Dr.” Magiera to ignore such a landmark ruling that has stood the test of time makes one wonder if he has read the Constitution at all?

“Dr.” Magiera calls for Remington’s resignation for doing and saying exactly what he should have said. Magiera shows that he has little understanding as to what the responsibilities are of a county health officer. They are required to be concerned with community health and well-being. They are to track data, point out areas that can help stop or prevent a disease from spreading. They are required to help local government put in place procedures to mitigate and stop outbreaks. They are not required to be constitutional scholars.

As to our “God given rights to liberty,” will someone please give “Dr.” Magiera a copy of the Constitution that he claims to love? Where in the Constitution does it say that you have a right to infect others with disease? That you by your willful negligence are allowed to cause others harm, infect them with disease and in some cases (650,000 to this point) cause death without restriction? I’ll give you a hint, it doesn’t.

Keep up the good work, Dr. Remington, you are right on the money!
