DePuy Suit Alleges Patent Violation

Globus Medical has filed a lawsuit against DePuy Synthes for patent violation of a spine stabilization device, orthopedic industry blog Massdevice.com reports.
Globus is accusing DePuy of violating its patent for an intervertebral fusion implant with DePuy’s Zero-P VA device. The Pennsylvania company filed suit against DePuy Synthes Products LLC and DePuy Synthes Sales Inc. in U.S. District Court in Delaware May 15.
According to the blog and other industry sources, Globus alleges in court documents that the Zero-P VA intervertebral fusion implant violates U.S. patent #8,328,872, which it received in December.
Globus’ requests include a jury trial and a judgment of willful infringement with accompanying triple damages. It also wants the court to order Synthes to recall and destroy any devices that infringe on the patent.
Synthes, which DePuy parent company Johnson & Johnson acquired last year, filed suit against Globus in July 2011 alleging the infringement of three intervertebral implants. That suit is still pending.
