A California judge has rejected DePuy Orthopaedics’ request for a new trial after a jury awarded $8.3 million to a hip implant patient who alleged the company was responsible for injuries caused by a recalled device. J. Stephen Czuleger, a judge for the Superior Court of Los Angeles, maintained Friday the March jury decision in favor of a retired prison guard who claimed he was injured by an ASL XR metal hip, orthopaedic and law industry sources report. The jury had found that the metal-on-metal implants were designed defectively. Czuleger denied the appeal on the grounds that the plaintiffLoren Kransky, had provided enough evidence to establish that the products were defective in design, according to Law360.com DePuy had attempted to put a hold on the jury’s decision in a filing in mid-April.
