NOTICE OF SALE OF REAL ESTATE

BEFORE THE KOSCIUSKO         SS:        COUNTY COMMISSIONERS
KOSCIUSKO COUNTY
    NOTICE IS HEREBY GIVEN by the Kosciusko County Commissioners of the sale of real property commonly known as 8993 East Epworth Forest Road, North Webster, Indiana 46555, and more particularly described as follows:
    Part of the Northwest Quarter of Section 12, Township 33 North, Range 7 East, Kosciusko County, Indiana, more particularly described as follows, to-wit:
    Commencing at the Northeast corner of the West fractional half of the Northwest quarter of Section 12; thence South 90 degrees 00 minutes West, on and along the North line of said Northwest quarter, a distance of 446.0 feet to the Northwest corner of a certain tract of land as recorded in Deed Record 301, page 136 in the records of Kosciusko County, Indiana, said Northwest corner being the true Point of Beginning; thence South 00 degrees 04 minutes East (recorded South), on and along the West line of said tract in Deed Record 301, page 136, a distance of 192.0 feet (recorded 186.5 feet) to the Southwest corner of said tract in Deed Record 301, page 136; thence North 88 degrees 45 minutes West (recorded West), on and along a line established by an existing fence line, a distance of 230.5 feet; thence North 18 degrees 00 minutes 30 seconds West (recorded North 11 degrees West), a distance of 196.6 feet to the North line of said Northwest Quarter, at a point over an outlet pipe for a ditch from a lake; thence North 90 degrees 00 minutes East, on and along said North line, being within the right-of-way of County Road 700 North a distance of 291.0 feet to the true Point of Beginning, containing 1.13 acres of land, more or less, subject to legal right-of-way for County Road 700 North.
    Bids will be received by the Kosciusko County Administrator, 100 West Center Street, Warsaw, Indiana 46580, beginning on June 5, 2015 and continuing from day to day until 3:00 PM prevailing local time on the 15th day of June, 2015.  The property may not be sold to a person who is ineligible under IC 36-1-11-16 (IC 36-1-11-16 applies to any person who owes delinquent taxes, special assessments, penalties, interest, or costs directly attributable to a prior tax sale on a tract of real property listed under IC 6-1.1-24-1,  and also to any such person’s agent).  A bid submitted by a trust (as defined in IC 30-4-1-1(a)) must identify each beneficiary of the trust and each settlor empowered to revoke or modify the trust.
    Bids shall be open to public inspection.  A bidder may raise the bidder’s bid, and any such raise shall take effect after the Kosciusko County Commissioners have given written notice of such raise to the     The Kosciusko County Commissioners may, before expiration of the time set out in the notice, sell the property to the highest and best bidder.  
    Bids should be clearly marked “Bid on Epworth Forest Road Property”, and mailed or hand-delivered to the Kosciusko County Administrator, 100 West Center Street, Warsaw, Indiana 46580.
    Two (2) appraisals have been obtained regarding the property yielding an average appraised value of $800.00.  A bid for less than ninety percent (90%) of this amount may not be accepted without additional notice being published stating the amount of the bid to be accepted.
    The successful bidder must agree in writing to (1) demolish all unsafe structures and buildings located on the said property, (2) remove all garbage, rubbish, and other debris from the said property, and (3) cause the property to be put in a healthful and sightly condition and must also deliver payment of the bid amount in full, all within one hundred and twenty (120) days of bid acceptance, and prior to receipt of a deed conveying ownership of the said property.
    The right is hereby reserved to reject any and all bids, to delete any portion thereof, or waive informalities in the bidding process.
