Code Enforcement Judge Issues Fine For Deck

Administrative Law Judge Thomas Earhart will fine a Warsaw man after a code enforcement hearing Tuesday.
At the hearing, homeowner Chad Patrick was called to provide updates on a deck addition that was not up to code at 852 Lydia Drive. Patrick did not appear.
Building Inspector Robert Hurford stated that he spoke with Patrick following the August code hearing and was ensured he had the requirements to get his deck up to code. Patrick informed him he would do the corrections himself with the help of family and/or acquaintances; however, he never followed up to schedule an inspection.
Since no communication was provided, Earhart fined Patrick $300 and will require him to attend the October code enforcement hearing.
Hurford also followed up with his recommendation from the previous meeting to fine Roger Burkholder. Burkholder was Patrick’s contractor whose noncompliance and “belligerent” behavior, as described in a previous meeting, led to the deck not being up to code. Earhart stated that he could not fine Burkholder, who was also not present, due to his actions being a civil matter that would have to be pursued by Patrick.
In other business, Code Enforcement dismissed the following cases after requirements were met:
• Shivkunj LLC., 2575 E. Center St.
• Larry and Diana Long, 104 E. Prairie St.
• Cathy Jo Wade, 815 E. Clark St.
• KS&F, 602 S. Morton St.
The next code enforcement hearing is Tuesday, Oct. 8.
