CLAYPOOL - In an attempt to recoup costs for reconstruction repairs at Beginnings Subdivision, a lawsuit has been filed against the original contractor.
Re-excavation and reconstructions of certain infrastructure were cited in the lawsuit filed by town attorney Mike Reed against Robert Leiter, doing business as Leiter Real Estate and Development and Construction, and Amwest Surety Insurance Co.
Repair costs are given as $19,543. Court costs are also included in the testimony.
In a lawsuit filed Oct. 11 in Kosciusko Superior Court I, the town states Leiter failed to complete the work by Sept. 30, 1998, working on the project into 1999. Several extensions were granted.
Some work was not performed according to specifications, the lawsuit says.
According to the lawsuit, Leiter failed to properly seat part of a sanitary sewer line between Lindsay and Rebecca streets; improperly installed a water line and failed to install a shut-off at the main line; buried water lines up to 4 feet deep and failed to install water taps each home could access, and failed to properly seat the storm drainage line installed along CR 700S.
The town hired another contractor, Ellsworth Everest Excavating, to repair these items over the course of a year.
The subdivision has two occupied homes and 20 total lots. It is west of town on the south side of CR 700S.
