ADVERTISEMENT FOR BIDS TOWN OF CLAYPOOL, INDIANA SECTION STREET DRAINAGE IMPROVEMENTS CONTRACT 2 Sealed Bids for the SECTION STREET DRAINAGE IMPROVEMENTS, CONTRACT 2, will be received by the Clerk Treasurer, at Town Hall, 408 South Graceland Avenue, until 10:30 a.m., local time, on February 25, 2010, at which time they will he publicly opened and read. Each proposal must be enclosed in a sealed envelope bearing the title of the Project and the name and address of the Bidder. In general, the work consists of the installation of approximately 3,100-ft. of 12-in. through 48-in. RCP storm drainage pipe and approximately 2,700-ft. of street improvements including asphalt overlay with new curb & gutters and sidewalks. A non-mandatory Pre-Bid meeting will be held on February 18, 2010, 10:00 am at Town Hall located at 408 South Graceland Ave, Claypool, Indiana. Copies of the Bidding Documents may be examined at the above office, or at the office of Jones & Henry Engineers, Ltd., 2420 Coliseum Boulevard North, Suite 214, Fort Wayne, Indiana 46805, without charge. Copies may be obtained from Eastern Engineering Supply at 1239 North Wells St., Fort Wayne, Indiana 46808, (www.easternengineering.com. phone no. 260.426.3119, fax no. 260.426.3101) upon the non-refundable deposit of $75.00, check only, made payable to Eastern Engineering Supply, for each set of Bidding Documents. Bids must be submitted on the forms bound herein, must contain the names of every person or company interested therein, and shall be accompanied by a Bid Bond in the amount of 5% of the amount bid with satisfactory corporate surety or by a certified check on a solvent bank in the amount of not less than 5% of the amount of the Bid made payable to the Owner, subject to Form 96 conditions provided in the Instructions to Bidders. The successful bidder will be required to furnish satisfactory Performance and Payment Bonds in the amount of 100% of the contract price and must be in full force and effect throughout the term of the Construction Contract plus a period of twelve (12) months from the date of substantial completion. Any Bid may be withdrawn prior to the scheduled closing time for receipt of Bids, but no bidder shall withdraw his Bid within 60 days after the actual opening thereof. The Owner reserves the right to reject and/or cancel any and all Bids, solicitations and/or offers in whole or in part as specified in the solicitation when it is not in the best interests of the governmental body as determined by the purchasing agency in accordance with IC 5-22-18-2. The Owner also reserves the right to waive irregularities in any Bid, and to accept any Bid which is deemed most favorable to the Owner. A conditional or qualified Bid will not be accepted, Award will be made to the low, responsive, responsible bidder. The low, responsive, responsible bidder must be approved by Grant Services. All applicable laws, ordinances, and rules and regulations of all authorities having jurisdiction over construction of the project shall apply to the project throughout. Wage rates on the project shall not be less than the Federal Davis-Bacon Wages as published by the U.S. Department of Labor. Bidders on this work shall be required to comply with the provisions of the President's Executive Order No. 11246, as amended. The Bidders shall also comply with the requirements of 41 CFR Part 60-4 entitled Construction Contractors - Affirmative Action Requirements. A copy of 41 CFR Part 60-4 may be found in the Supplemental General Conditions of the Contract Documents and Specifications. The Bidders attention is also called to the Minority Women Business Participation requirements contained in the Project Specifications. Grant Services has adopted a State goal of 10% participation for minority and female owned businesses for construction related or purchase related contracts for the work. In addition, the Contractor must meet guidelines and practices .established by Grant Services and appropriate Federal regulations including: 1) Executive Order 11246,2) Section 3 of the Housing and Community Development Act of 1968, as amended, 3) Certification of Non-Segregated Facilities, 4) OMB Circular A-102, 5) Title VI of the Civil Rights Act of 1964, 6) Section 504, Rehabilitation Act of 1973, 7) Age Discrimination Act of 1975,8) Executive Order 12138, 9) Conflict of Interest Clause, 10) Retention and Custodial Requirements for Records Clause, 11) Contractors and Subcontractors Certifications, and others that may be appropriate or necessary.
