ORDINANCE NO. 2011-4-1 AN ORDINANCE AMENDING ORDINANCE NUMBER 1999-3-1, AN ORDINANCE AMENDING ORDINANCE NUMBER 1997-6-1, THE SEWER RATE ORDINANCE WHEREAS, the Town Council of the Town of Claypool has previously adopted Ordinance Number 1999-3-1, An Ordinance Amending Ordinance Number 1997-6-1, The Sewer Rate Ordinance, on March 25, 1999; and WHEREAS, the Town Council passed Ordinance No. 2011-3-1 on March 21, 2011 modifying and reducing the rates and charges based upon the flow rate per thousand gallons of water used as provided in Ordinance Number 1999-3-1 to provide more reasonable, just, and equitable rates for the users of the Claypool Sewer Works who have water meters; and WHEREAS, the Town Council has determined that it is appropriate to modify and reduce the rates and charges similarly for those persons who are unmetered users. NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF CLAYPOOL, INDIANA: Section 1. That Article Two of Ordinance Number 1999-3-1 is hereby repealed and rendered null and void. Section 2. That Article Two of Ordinance Number 1997-6-1 be modified and changed and the rates and charges for the base rates per month shall be as follows for unmetered users: Base Rate Per Month: User Charge Debt Service Total Single Family Dwelling Unit $14.60 $38.55 $53.15 Section 3. That this Ordinance shall supercede the provisions of Ordinance Number 1999-3-1, Article Two, An Ordinance Amending Ordinance Number 1997-6-1, The Sewer Rate Ordinance, as applicable, and this Ordinance shall be in full force and effect from and after its passage and due publication as provided by law. This provisions of Ordinance Number 1999-3-1 which are not modified by this Ordinance shall remain in full force and effect.
