ORDINANCE NO. 2011-05-01 AN ORDINANCE TO ESTABLISH AN ORDINANCE VIOLATIONS BUREAU AND SCHEDULE OF ORDINANCES SUBJECT TO ADMISSION OF VIOLATION IN THE TOWN OF CLAYPOOL WHEREAS, Indiana Code 33-36-2-1 et seq. allows a legislative body of a municipal corporation to establish by ordinance an Ordinance Violations Bureau; and WHEREAS, the legislative body of a municipal corporation can appoint a Violations Clerk who administers said Violations Bureau; and WHEREAS, the Violations Clerk, pursuant to Indiana Code 33-26-2-1 et seq. can accept written appearances, waivers of trial, admissions of violations, and payment of civil penalties, in ordinance violation cases, subject to the schedule of ordinances prescribed by the legislative body; NOW, THEREFORE, BE IT ORDAINED by the Town Council of the Town of Claypool, Kosciusko County, Indiana, as follows: Section 1. That there shall be created an Ordinance Violations Bureau for the Town of Claypool as provided in I.C. 33-36-2-1 et seq., and the Town Clerk shall serve as the Violations Clerk of such Bureau. Section 2. This Ordinance does not amend the penalty section of the Claypool Town Code or any Claypool Town Ordinance. Section 3. That the Violations Clerk shall accept written appearances, waivers of trial, admissions of violations, and payment of civil penalties of not more than Two Hundred Fifty Dollars ($250.00) in ordinance violation cases. Section 4. That all of the ordinances of the Town of Claypool shall be subject to admission of violation before the Violations Clerk except as may be specifically provided otherwise in the specific ordinance providing for such violation, or except as provided otherwise by Indiana law. Section 5. That any person, corporation, or organization who commits more than one (1) violation of any ordinance within any thirty (30) day period will be subject to an increased fine as set forth in the specific ordinance providing for such violation. Every day, or part of a day, that a violation is committed or continues in existence is a separate violation for which civil penalties may be imposed. Section 6. That this Ordinance shall be in full force and effect from and after its passage and due publication as required by law.
