ORDINANCE NO. 11-03-05 AN ORDINANCE ESTABLISHING SPEED LIMITS ON TOWN STREETS WHEREAS, the Town Council of the Town of Claypool has considered safety issues and speed limits set on Town streets, including Section Street, which is currently thirty miles per hour (30 mph); and WHEREAS, the Town Council of the Town of Claypool has determined that the maximum speed permitted under I.C. 9-21-5-1 et seq. is greater than reasonable and safe under the conditions found to exist on Town streets; and WHEREAS, the Town Council of the Town of Claypool has determined it is prudent to reduce the maximum speed limits on Town streets as provided in I.C. 9-21-5-6. NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL., OF THE TOWN OF CLAYPOOL, INDIANA: Section 1. That the maximum speed limit on all Town streets located within the Town Limits of the Town of Claypool, Indiana, except Section Street, shall be twenty-five miles per hour (25 mph). Section 2. That no person shall drive a vehicle on Town streets in excess of the maximum speed limits as established herein. Section 3. That the penalty for each violation of this Ordinance shall be not less than Twenty Five Dollars ($25.00), nor more than One Hundred Dollars ($100.00) depending on the speed being traveled by the vehicle violating this Ordinance. Section 4. This Ordinance shall be in full force and effect from and after its passage and due publication as provided by law.
