ORDINANCE NO. 2015-03-01 AN ORDINANCE REGULATING PARKING WHEREAS, the Town Council of the Town of Claypool has considered the fact that certain businesses have been established in the Town which require parking for their customers; and, WHEREAS, the Town Council deems it appropriate, for the common good of the residents and businesses within the Town, to regulate parking on South Main Street and to limit this parking solely to patrons of businesses located adjacent to South Main Street and within the Town. NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF CLAYPOOL, INDIANA: Section 1. Parking shall be limited on South Main Street, between Section Street and Calhoun Street, solely to those persons who are visiting or using one of the businesses located adjacent t Main Street and within the Town limits during the hours these businesses are open to the pubic. That in addition, thereto, parking shall be prohibited in this same area from 4:00 o'clock A.M. to 6:00 o'clock A.M. during the months of November 1 through April 1, hereafter. Section 2. The penalty for the first violation of this Ordinance shall be Twenty Five Dollar ($25.00). The penalty for a second violation of this Ordinance shall be Fifty Dollars ($50.00). The penalty for a third or subsequent violation of this Ordinance shall be Seventy Five Dollars ($75.00). In addition to the fines assessed for a violation of this Ordinance, any person who violates this Ordinance shall also be responsible for, and shall pay, any and all costs and attorney fees incurred by the Town in enforcing this Ordinance including, but not limited to, any costs and attorney fees incurred in the filing and prosecution of an action for the violation of this Ordinance in any appropriate court of law. Section 3. All parts of Ordinances in conflict herewith are hereby repealed. Section 4. This Ordinance shall be in full force and effect from and after its passage and due publication as provided by law.
