A Claypool man, who stabbed his mother with a pair of scissors over a broken cigarette, will spend the next three years in prison for it.
Justin W. Siede, 29, of 9752 S. Pheasant Place, Claypool, appeared Monday in front of Kosciusko Superior Court I Judge David Cates and was sentenced to five years in the Indiana Department of Corrections for a Level 5 felony conviction of domestic battery while armed with a deadly weapon, with two years suspended to formal probation; to one year in the IDOC, all suspended, for a Class A misdemeanor domestic battery conviction; and to one year, all suspended to probation, for interfering in the reporting of a crime, a Class A misdemeanor.
Siede had accrued 245 days of jail time credit and asked Cates to send him to prison so he can take part in their education and workforce readiness programs.
Cates told Siede he hopes he will not only take advantage of those offerings but learn to stop breaking the law.
The case stems from a Jan. 23 incident where police responded to a home in reference to a stabbing. The investigation determined that Siede was looking for a pair of scissors to cut the filter off his cigarette and trashed his mother’s bedroom looking for them.
Siede located a pair of craft scissors, according to court papers, and then told his mother he was not going to share the cigarette. His mother snapped the cigarette in half, causing Siede to stab her in the arm then wrestled her cell phone away from her.
Another woman in the home was able to call 911, after battling with Siede for her phone, court documents state.
According to court records, Siede was convicted of a Level 6 felony for domestic battery against his mother in Fulton County last October.
