NOTICE OF DETERMINATION TO CONSTRUCT AND FINANCE ADDITIONS, EXTENSIONS AND IMPROVEMENTS TO THE NAPPANEE SEWAGE WORKS AND THE ADOPTION AND PURPORT OF THE ORDINANCE AUTHORIZING SAME Property owners, ratepayers and other interested parties in or served or to be served by the sewage works of the City of Nappanee ("City") are hereby notified that on November 17, 2008, the Common Council adopted Ordinance No. 1423, thereby determining to construct additions, extensions and improvements to the City's sewage works consisting of: wastewater treatment plant improvements, including the addition of two new aerobic digesters; new biosolids handling equipment including a biosolids press and building and a new biosolids roofed storage facility; the installation of new air blowers/air handling equipment for all areas of the existing treatment plant; and the addition of ultra violet disinfections equipment and all related equipment and appurtenances ("Project"), pursuant to plans and specifications prepared by Commonwealth Engineers, Inc., consulting engineers of Indianapolis, Indiana. The total cost of the Project is estimated not to exceed $5,000,000. Ordinance No. 1423 further directed that the cost of the Project be financed by the issuance of revenue bonds in an amount not to exceed $5,000,000, which bonds will be payable solely from the net revenues of the sewage works. The bonds will be sold at a competitive sale at an interest rate not to exceed 6.5% per annum and will mature annually on January 1 over a period ending no later than January 1, 2029. Copies of the plans, specifications, cost estimates and of Ordinance No. 1423 are on file in the office of the Clerk-Treasurer and are available for inspection by any interested parties during regular business hours. Objections to said Project and the bonds may be filed in the time and manner provided by the Indiana Code, Title 36, Article 9, Chapter 23. Dated this 17th day of November, 2008. /s/ Kimberly A.
