NOTICE OF PUBLIC HEARING NAPPANEE CITY PLAN COMMISSION The City of Nappanee Plan Commission will hold a Public Hearing Thursday, April 16, 2009 at 7:00 p.m. in the Council Chambers at the Nappanee Municipal Center, 300 W. Lincoln St., Nappanee, Indiana. The purpose of this hearing is to hear the following rezoning request by Weston, LLC, 1301 Stahly Drive, Nappanee, Indiana 46550 by and through it's duly authorized agent, Harvey Kemp. The request has been filed to change the zoning from I-1, Industrial to PD-E Planned Development-Extraordinary to allow for a mixed use of manufacturing and commercial at the building at 1301 Stahly Drive Nappanee, IN more particularly described as follows: LEGAL DESCRIPTION OF PROPERTY: REAL ESTATE Tract 1: A part of the northeast quarter (NE 1/4) of the southeast quarter (NE 1/4) of section thirty-one (31), township thirty-five (35) north, range five (5) east, City of Nappanee, Elkhart County, Indiana, more particularly described as follows; Commencing at a bronze plug at the northeast corner of the southeast quarter (SE 1/4) of said section; thence south zero (00) degrees three (03) minutes west along the east line of the southeast quarter SE 1/4) of said section, seven hundred nineteen and ninety-five hundredths (719.95) feet; thence north eighty-nine (89) degrees fifty-three (53) minutes west parallel with the north line of the southeast quarrier (SE 1/4) of said section, five hundred thirty-one and eighty-seven hundredths (531.87) feet; thence south zero (00) degrees three (03) minutes west, twenty (20) feet; thence north eighty-nine (89) degrees fifty-three (53) minutes west, one hundred fifty (150) feet for the beginning point of this description; thence north eighty-nine (89) degrees fifty-three (53) minutes west, four hundred ninety-nine and thirty-seven hundredths (499.37) feet to a point that is one hundred forty-two (142) feet east of the west line of the northeast quarter (NE 1/4) of the southeast quarter (SE 1/4) of said section; thence south zero (00) degrees eighteen (18) minutes west parallel with the west line of the northeast quarter (NE 1/4) of the southeast quarter (SE 1/4) of said section, two hundred forty-eight and forty-eight hundredths (248.48) feet to the northerly right-of-way line of the Baltimore & Ohio Railroad; thence south eighty-three (83) degreed fifty-five (55) minutes east along the northerly right-of-way line of said railroad, five hundred three and eleven hundredths (503.11) feet to a point that is south zero (00) degrees three (03) minutes west of the place of beginning; thence north zero (00) degrees three (03) minutes east, three hundred and eighty-two hundredths (300.82) feet to the place of beginning. TRACT II: A part of the southeast quarter (SE 1/4) of section thirty-one (31), township thirty-five (35) north, range five (5) east, City of Nappanee, Elkhart County, Indiana, more particularly described as follows: Commencing on the north line of the Baltimore & Ohio Railroad right-of-way on the east line of Miriam Avenue in the City of Nappanee, Indiana; thence north zero (00) degrees eighteen (18) minutes east; two hundred forty-eight and forty-eight hundredths (248.48) feet; thence north eighty-nine (89) degrees fifty-three (53) minutes west, seventy-one (71) feet; thence south zero (00) degrees eighteen (18) minutes west to the north line of the Baltimore & Ohio Railroad right-of-way; thence eastwardly along the north line of said right-of-way, seventy-one and thirty-six hundredths (71.36) feet to the point of beginning. A copy of such proposal is on file in the office of the Zoning Administrator of the city of Nappanee, Indiana, City Municipal Building, 300 W. Lincoln St., Nappanee, Indiana. Written objections filed with the office of the Zoning Administrator of the City of Nappanee before the hearing will be considered. All concerned citizens will be offered the right to speak and voice their comment at the Public Hearing. The Public Hearing may be continued from time to time as may be found necessary.
