This is in response to Mr. Hollar's letter regarding child support. I have read your letter and I am astounded that you have the audacity to blame the judicial system for your negligence in supporting your child/children.The Child Support Division attempts to make every effort to exhaust all civil remedies available to them in order to enforce and collect the child support arrearage. If this is unsuccessful, criminal charges may be appropriate. Indiana Code 35-46-1-5 provides that a person, who knowingly or intentionally fails to provide support to a dependent, commits Nonsupport of a Child, a class D felony.

It is a Class C felony if the amount of unpaid support due and owing for one or more children is at least $15,000.

A Class D felony is punishable by 1/2 to 3 years imprisonment and/or a fine of $10,000. A Class C felony is punishable by 2 to 8 years imprisonment and/or a fine of $10,000.

Having said all this, I am curious to find out whether Mr. Hollar reported to his child support case worker that he was out of work? Perhaps he just "assumed" that they already knew. I have news for you, Mr. Hollar; it is your responsibility to make the folks down at the child support office aware of your circumstances. As far as you comparing your sentencing with that of the Etna Green bank robbers, in my opinion, you are the bigger criminal. You are nothing more than a malefactor who should be ashamed of himself for complaining about getting in trouble for not supporting his child/children.
