The Warsaw Board of Zoning Appeals approved Dale Custer's request Monday night for a variance on developmental standards for two lots in the Eagle Crest subdivision.
Custer now has allowance for a depth-to-width ratio greater than three-to-one for lots 37 and 38 in Eagle Crest.
This approval grants Custer the ability to plat his lots without disturbing the existing wetlands or alignment of streets in both Eagle Creek and Park Ridge subdivisions. Both lots meet the lot width and square footage requirements, and will not have an adverse effect on surrounding properties.
Ginger Carboneau, 1 Fairlane Drive, appeared before the committee to request a variance from developmental standards to allow a 5-foot variance from the 10-foot yard setback for privacy fences. Carboneau wanted to replace her current 4-foot chainlink fence with a 6-foot privacy fence.
The board declined her petition, citing the placement of a privacy fence along a 5-foot setback would not be in the best interest for the general public's safety.
"I know the traffic coming out of Fairline Drive and the fairgrounds, and having the open area for visibility is convenient to the public," Board Member Bruce Woodward said.
Carboneau mentioned to the board the construction of a larger 6-foot fence, which members responded would be permissible by developmental standards but must be located at least 10 feet from the property line.
BZA members are Dan Hampton, Alan Clingan, Bruce Woodward and Richard Keeven. Bill Rhoades is the city council's representative.
