It wasn't a case of "less is more" Monday when the Warsaw Board of Zoning Appeals granted a variance for a rear setback for Maxx Tan II at 2624 E. Jefferson St.
But it was a case of less is better.
Building owner Kerry Clevenger was seeking a variance for a 10.33-foot rear setback, when 20 feet is required.
According to Dick Green, attorney for Clevenger, the expansion of the building to the rear, while coming closer to the rear property line than the zoning code allows, would not be a detriment to the surrounding property owners.
"We believe that, even with the addition, there would still be room for vehicular traffic," Green said. "We don't see how this would decrease any availability to light or air to any adjoining properties.
"Nor will it pose any increased threat of fire to the surrounding properties," he added. "To not allow this variance would pose an unnecessary hardship upon the property owner."
The expansion will allow the placement of three additional tanning beds that are needed to meet the demands of the customers, said Travis Martin, manager of the tanning business.
The board approved the variance request, with the condition that air conditioning units be relocated to the side of the building.
"If you make the addition and move the air conditioner to the side, you're actually making the situation better," said board member Dick Witt.
