IN THE MATTER OF THE PETITION OF OTIS R. BOWEN CENTER FOR HUMAN SERVICE, INC. TO VACATE A PORTION OF CERTAIN STREET IN PLAT OF THE SEVENTH AMENDED AND ADDITIONAL PLAT OF WINONA PARK TO

KOSCIUSKO COUNTY, INDIANA

BEFORE THE COMMON COUNCIL OF THE CITY OF WARSAW

    The Common  Council  of the City of Warsaw, Indiana, shall hold a public hearing on a petition  filed  by Petitioner,  Otis  R.  Bowen  Center  for  Human  Services,  Inc.,  requesting  the vacation of a portion of certain streets in the plat of Seventh  Amended  and Additional  Plat of Winona Park to City of Warsaw,  Kosciusko  County, Indiana.  The hearing  will be held in the Common Councils'  meeting  room at 102 S. Buffalo Street, Warsaw, Indiana,  46580, on the 1st day of October, 2018, at 6:00 p.m. All interested persons are invited to attend and be heard. A copy of the petition of Otis R. Bowen Center for Human Services, Inc. for said vacation is on file and available for public inspection  at the office of the Common  Council. The legal descriptions of the properties to be vacated are as follows:

DESCRIPTION  OF SURVEYED TRACT I

    Part of Adams Street as shown in the recorded Plat of the Seventh Amended and Additional Plat of Winona Park, as recorded in Plat Book 1, page 59 in the records of Kosciusko County, Indiana, more particularly described  as follows, to wit:

    BEGINNING at an iron pin found at the Northeast corner of Lot Number 355 in said Seventh Amended and Additional Plat; thence S00°-02'-00"E (GPS Grid bearing and used as the basis of bearings for this description), on and along the East line of said Lot Number 355 and Lot Number 304 in said Seventh Amended and Additional Plat, also being on and along the West right-of-way line of Adams Street, a distance of 208.50 feet to a 5/8-inch iron pin capped "Walker" found at the Northeast corner of a certain tract of land as recorded in Document Number 2015010719 in said records, said iron pin being situated N00°-02'-00"W, a distance of 72.00 feet from a 5/8-inch iron pin capped "Walker" found at the Southeast corner of said Lot Number 304; thence S89°-44'-08"E, on and along the Easterly projection of the North line of said tract of land in Document Number 2015010719, a distance of 48.50 feet (recorded 50 feet), to a Mag nail on the East right-of-way line of said Adams Street, said Mag nail being on the West line of a certain tract of land as recorded in Document Number 2011110640 in said records; thence N00°-04'-56"E,  on and along said East right-of-way line, also being on and along said West line and on and along the West line of a certain tract of land as recorded in Document Number 2016121084 in said records, a distance of 208.50 feet to a Mag nail at the point of intersection with the Easterly projection of the North line of said Lot Number 355; thence N89°-44'-05"W, on and along said Easterly projection, a distance of 48.92 feet (recorded 50 feet), to the point of beginning, containing 0.23 acres of land, more or less, subject to all legal right-of-way, subject to all legal drain easements and all other easements of record.

DESCRIPTION  OF SURVEYED  TRACT II

    Part of Adams Street as shown in the recorded Plat of the Seventh Amended and Additional Plat of Winona Park, as recorded in Plat Book 1, page 59 in the records of Kosciusko County, Indiana, more particularly  described  as follows, to wit:

    Commencing at an iron pin found at the Northeast corner of Lot Number 355 in said Seventh Amended and Additional  Plat; thence S00°-02'-00"E (GPS Grid bearing and used as the basis of bearings for this description), on and along the East line of said Lot Number 355 and Lot Number 304 in said Seventh  Amended and Additional Plat, also being on and along the West right-of-way line of Adams Street, a distance of 208.50 feet to a 5/8-inch iron pin capped "Walker" found at the Northeast corner of a certain tract of land as recorded in Document Number 2015010719 in said records, said iron pin also being at the POINT OF BEGINNING;  thence S89°-44'-08"E, on and along the Northerly projection of said tract of land in Document Number 2015010719,  a distance of 48.50 feet (recorded  50 feet), to a Mag nail on the East right-of-way line of said Adams Street, said Mag nail being on the West line of a certain tract of land as recorded  in Document number 2011110640 in said records; thence S00°-04'-56"W,  on and along said East right-of-way line, also being on and along said West line, a distance of 72.00 feet to the point of intersection with the Easterly projection of the South line of said Lot Number 304; thence N89°-44'-08"W, a distance of 48.36 feet to a 5/8-inch iron pin capped "Walker" at the Southeast corner of said Lot Number 304; thence N00°-02'-00"W, on and along the East line of said Lot Number 304, also being on and along the West right-of-way line of said Adams Street, a distance of 72.00 feet to the point of beginning, containing 0.08 acres of land, more or less, subject to all legal right-of-way, subject to all legal drain easements and all other easements of record.
