BOURBON - Plan commission members unanimously agreed to a property division, but attached conditions for the future use of the property.
Commission secretary Ellen Elliott reported that local businessman Glenn Danner would like to divide his property at 410 E. Center St. between his sons and his business partner, Steve Neidig. Danner has operated an auto repair shop from a building behind his home for more than 40 years. The property is zoned light industrial. He plans to separate the house and garage, resulting in two lots, each 69 feet by 155 feet in size. Access to the business is now gained by a narrow strip of land owned by the town and used as a limited access alley to the town water plant. Elliott said town ordinance states all lots must have street frontage. However, she said, there are exceptions.
The commission agreed the property could be divided as a means to encourage the business but the town should control the future use with a stipulation no future owner of the garage property could replace that building with a house.
In other matters:
Building permits were approved for Larry Lemler, 2436 12th Road, for a 13-by-25-foot garage addition; Brad Mason, 402 Rose Lane, a 10-by-12-foot storage barn; and Kathryn Chapman, 2259 12th Road, an 11-by-15-foot porch addition to her home.
Elliott informed the board of a stop work order issued to Lynda Arthurhultz, 705 N. Main St., because of an insufficient side and rear yard setback for the construction of an above-ground swimming pool and deck. She explained the required setback is 15 feet from both side and rear yard boundaries and there would be only an 8-feet setback in this case. In the Board of Zoning Appeals meeting following the Plan Commission, the BZA unanimously approved a reduction of the setbacks so the construction can proceed.
