TO THE CITIZENS OF KOSCIUSKO COUNTY, INDIANA
You are hereby notified that a petition has been filed with the County Commissioners, Kosciusko County, Indiana by the above named Petitioners, requesting the vacation by ordinance of a certain undeveloped and unimproved roadway located in Bensart's North Shore Park and Bensart's North Shore Park, Second Addition, near Beaver Darn Lake, and more particularly described as follows:
A roadway vacated in the Plat of Bensart's North Shore Park, Plat of the Second Addition to Bensart's North Shore Park, Page 387-B, all in Kosciusko County, Indiana and more particularly described as follows:
A public way described in the records of Kosciusko County as part of "Upper Bensart Drive" and more particularly described as follows: Beginning at the Northwest corner of the East half of Lot 6 in the plat of Bensart's North Shore Park; thence Easterly along the North line of the East half of Lot 6, the North line of Lot 3, the North line of Lot 2 in Bensart's North Shore Park subdivision, and the North line of a tract to the East of Lot 2, to the intersection with the North line of Bensart Drive; thence Northeasterly along the North line of Bensart Drive approximately fifty feet (50') to the North line of Upper Bensart Drive where
it intersects Bensart Drive; thence Westerly along the North line of Upper Bensart Drive a distance of approximately 260 feet to a point Northerly of the Point of Beginning; thence Southerly to the Point of Beginning along the line which is the West line of the East half of Lot 6, extended; thence Southerly a distance of twenty feet (20'), more or less, to the Point of Beginning.
The above description is intended to describe all of Upper Bensart Drive from its intersection with Bensart Drive on the Northwest corner of the East half of Lot 6 in Bensart's Northshore Park subdivision.
You are hereby notified that the County Commissions of Kosciusko County, Indiana, have set the above petition for hearing at 9:00 o'clock a.m., January 9, 2018, at the Kosciusko County Courthouse, 100 West Ce ter Street, Warsaw, Indiana 46580. Any person may appear and be heard upon the petition at the time, date and place above scheduled for hearing and/or may send written comments or response to the Auditor of the Kosciusko County, Indiana, 100 West Center Street, Warsaw; Indiana 46580, prior to the above time and date set for hearing.
After hearing, the petition may be granted, denied or continued, and an ordinance may be introduced and passed according to law, providing for the vacation of said roadway.
