A Claypool man was arrested Sunday after allegedly ignoring a no-contact order for a woman from a previous relationship and is accused of battering and strangling her.
Austen Everett Alan Lyke, 23, of 106 W. North St., Claypool, was arrested and booked into the Kosciusko County Jail at 8:34 p.m. Sunday on two counts of invasion of privacy, domestic battery in the presence of a child under 16, strangulation, interfering with the reporting of a crime and criminal confinement. His preliminary bond was set at $6,000.
Court documents filed Tuesday list charges against him as domestic battery with serious bodily injury, a level 5 felony; domestic battery with a child under 16 present, a level 6 felony; strangulation, a level 6 felony; stalking, a level 6 felony; domestic battery, a Class A misdemeanor; and invasion of privacy, a Class A misdemeanor. It lists his bond as $10,000 surety and $250 cash.
The court documents also list his address as 3205 Heron Blvd., Warsaw.
On Sunday, Warsaw Police officer Jacob Metzger responded to a domestic battery call at 3205 Heron Blvd. Upon arrival, he spoke with a woman who said Lyke came to her house wanting to fix their relationship. She told Lyke he had a no-contact order. He became angry and she went to the bathroom with another person who police did not identify. Lyke followed her to the bathroom and began calling her names. She then used her phone to video the conversation and was attempting to call 911 when Lyke took her phone.
She said Lyke then shoved her head against the door. He then placed her in a chokehold and she could not breathe. She became frantic and was hitting his arms, then she lost consciousness. She was in fear for her life and kicked the door, attempting to make enough noise for the neighbor to hear her. Lyke then left the residence, court documents state.
Metzger saw dents in the door from where the door was being kicked. He saw redness around the victim’s neck and a scratch on her chin.
Later in the evening, WPD officer Daniel Clemens responded back to the residence in reference to Lyke’s family members taking her vehicle. Upon arrival, Clemens spoke with the victim who said Lyke’s relatives came to her residence and took her Dodge Ram truck. She said the truck was registered to her and Lyke.
WPD officer Ryan Petty found the truck and spoke with Lyke who said he told his relatives to go to the woman’s residence and take the truck.
Court documents indicate Lyke has a pending criminal case of domestic battery in Kosciusko County Superior Court III. The woman also is the victim in that case.
