Arrests Made Monday for Intimidation, Sexual Misconduct

Two men were arrested Monday evening on charges of intimidation with a deadly weapon and sexual misconduct with a minor.
Charles W. Lewallen, 77, of 9814 N. CR 500E, Syracuse, was arrested at 8 p.m. Monday for intimidation with a deadly weapon, a Class C felony, resulting from a July 1 incident. James Robert Carpenter, 24, of 401 Wooster Road, Winona Lake, was arrested 10:17 p.m. for sexual misconduct with a minor, a Class B felony.
According to the probable cause affidavit for Lewallen on July 1, Lewallen went to 213 S. Main Street, Milford, and spoke to Jackie Coy. Coy informed police that Lewallen said he was looking for Barbara Harrison so that he could shoot her. Coy noticed a shotgun in Lewallen’s green Chevy Suburban.
Police spoke with Harrison and she said that she saw Lewallen at the building that night and that he had called her several times saying that he was going to kill her and Christopher Davis.
When officers spoke with Lewalen he admitted that he went to Harrison’s residence with the intent to kill her.
According to the probable cause affidavit for Carpenter, on March 27, 2011, Winona Lake Police Department officers responded to a call of men taunting a man at 401 Wooster Road, Winona Lake. When officers arrived they noticed a Ford Taurus leaving the area quickly. They stopped the car and found James Carpenter and a female passenger.
Carpenter identified himself as the complainant and said that the subjects had left the area. The passenger stated that the subjects were her brothers and that they were there to fight Carpenter, because they did not want them together.
Officers drove the passenger to her residence and spoke with her mother. The mom alleges that her 15-year-old daughter had been having sex with Carpenter. Carpenter admitted that he had sex with the daughter four or five times beginning in Oct. 2010 and that they had sex again in Feb. 2011. Carpenter also said he knew that the girl was 15.
Lewallen and Carpenter were booked into the Kosciusko County Jail on $2,000 and $10,000 bonds respectively. Lewallen posted bail at 8:17 p.m. Monday night. Carpenter is still in KCJ.
