Area Plan Commission Won't Recommend More CAFO Regs

Kosciusko Area Plan Commission decided Wednesday not to recommend any more regulations concerning Confined Animal Feeding Operations.

During its monthly meeting Wednesday afternoon, the plan commission decided, by a majority vote, not to proceed with any additional regulations of CAFOs.

The board went over what current legislation is being looked over by state representatives regarding agriculture.

Dan Richard, Area Plan director, sits on legislative boards and told the plan commission that the one bill that has come out of committee is one that will punish those who bring what is determined to be “frivolous” lawsuits against farms.

The bill would force those bringing such lawsuits to pay the legal costs that farms would have to take on.

The Plan commission also went over a map drawn out by the county’s plan department that shows where CAFOs could go based on new Indiana Department of Environmental Management setbacks that go into effect July 1.

Those include setbacks from public wells and public buildings.

The plan department also discussed the CAFO issue with the Wawasee Area Conservancy Foundation and the Tippecanoe Watershed Foundation.

The plan commission also approved rezoning 24.792 acres from public use to an agricultural district.

The property is on the west side of CR 825E at the intersection with CR 1250N in Turkey Creek Township.

The plan commission approved a vacation of an undeveloped public way on B42C Lane.

The plan commission also held a lot size/coverage discussion at Wednesday afternoon’s meeting.
