NOTICE OF PUBLIC HEARING UPON PETITION FOR VACATION OF PUBLIC WAYS STATE OF INDIANA SS KOSCIUSKO COUNTY IN RE: PETITION TO VACATE A PUBLIC WAY ANIMAL WELFARE LEAGUE OF KOSCIUSKO COUNTY, INC., Petitoner BFORE THE KOSCIUSKO COUNTY COMMISSIONERS NOTICE IS HEREBY GIVEN that the Animal Welfare League of Kosciusko County, Inc., as Petitioner, has filed a verified petition with the Kosciusko County Commissioners seeking the vacation of a public way, which petition has been set for a hearing before the Kosciusko County Commissioners on the 24th day of FEBRUARY, 2015, at 9:15 AM. The hearing will be held in the Commissioners’ Room (old Court room) which is located on the Third Floor of the Kosciusko County Courthouse, located at the corner of North Buffalo Street and West Center Street, Warsaw, Indiana. The Petitioner is seeking vacation herein for a public way that is located at the West side of your Petitioner’s property and known as Elaine Drive, which public way is more particularly described as follows, to-wit: Elaine Drive in the plat of Marathon Industrial Park as shown in Plat Book 7, Page 83 (Plat No. 22547), located in Wayne Township, Kosciusko County Indiana. LESS AND EXCEPTING that portion of said Elaine Drive previously vacated per Kosciusko County Commissioners Ordinance No. 96-5V and recorded in the Kosciusko County Recorder’s Office as Document #96090004 also described as: Elaine Drive, a 50 foot right-of-way described in the plat of Marathon Industrial Park and constituting a 50 by 270 foot segment of the platted “Elaine Dr” more particularly described as commencing 50 feet North 16 degrees 57 minutes East of the Southwest corner of the Plat of Marathon Industrial Park and thence 50 feet by parallels and 270 feet Northward of the Point of Beginning; more particularly described as the Point of Beginning; thence 270 feet more or less North 16 degrees 57 minutes East; thence 50 feet in an Easterly direction thence South 270 feet more or less by parallel; thence Westerly to the Point of Beginning. ANY PERSON desiring to be heard may file objections or comments with the Kosciusko County Commissioners with the Auditor of Kosciusko County, Indiana, or the Kosciusko County Area Plan Commission, and any person may appear at said hearing and be heard in support or objection of the petition filed herein. The hearing may be continued by the Kosciusko County Commissioners without further public notice. A copy of the petition is on file in the Office of the Auditor of Kosciusko County, Indiana.
