It should be apparent to all concerned citizens of our democratic constitutional republic that an additional barrier needs to be added to our system of checks and balances between the federal government and the states. Just as the federal government can intervene into the affairs of local and state government to prevent unconstitutional practices from being perpetrated by such governments against the citizens and inhabitants under their jurisdictions. So should the states be able to block any harmful actions from being perpetrated by the federal government against the citizens and inhabitants of the United States.
Therefore I believe a constitutional amendment allowing for nullification or a group veto by the states as a whole should be ratified, to explicitly give such legal authority to the states to eliminate any potential gray area conflicts, misinterpretations, legal loopholes for those seeking to exploit such loopholes for nefarious reasons. I have written such an amendment and I am presenting the first part of the amendment for those readers of the Times-Union who would be interested in using it as part of a letter in contacting federal elected officials. The remaining parts of the amendment which will include sections on the necessary majorities for passage of an act of nullification and safeguards for the preservation of individual rights will follow at later dates.
Proposed Constitutional Amendment (Nullification)
The states as a whole shall have the authority to veto any part or whole of an executive order signed by the president, a legislative act passed by Congress, a Supreme Court ruling, an international treaty ratified by the Senate, or regulations issued by a federal bureaucratic agency, and the enforcement by the federal government of any decree, law or regulation approved by any international or transnational authority made after the ratification of this amendment unless such an act infringes upon the natural and constitutional rights of the citizens and inhabitants of the United States and its territories.
