Three properties were brought before Warsaw code enforcement hearing officer Larry Clifford Monday with only one respondent appearing at the hearing.
Gary Warnacut attended the meeting regarding his property at 121 W. Market St. In June he was asked to seed the property and get grass growing, which he has done, with little cooperation from dry, hot conditions.
Clifford advised Warnacut he might want to keep a sprinkler on the lot to really establish the grass before the snow flies.
No fines were levied in the case and Warnacut said he doesn't expect to be back in October.
Neither Robert nor Beverly Eherenman appeared at the hearing regarding property at 402 E. Center St., a vacant lot.
Denny Dell of Rochester reportedly is buying the land on land contract, however, the deal is not on record at the courthouse. Certified letters were sent to both parties and neither responded.
There were orders to restore the property by July 8 and another $1,500 fine was imposed for failure to comply with the civil order.
Clifford advised attorney Bill Fawley and Giselle Cox of the planning and building department to send a certified letter to the Eherenmans again at their local address advising them of the fine and asking them to appear at the Oct. 21 hearing.
David and Barbary Gardonio were fined $1,000 for failure to comply with former orders regarding a house at 414 W. Fort Wayne St.
Todd Slabaugh, Warsaw building commissioner, said there are orders to repair the foundation of the building dating back to 1998. The house also is so close to the house next door that the eaves trough overlaps the roof. He presented several photographs of the building and property.
A certified letter advising the Gardonios of Monday's meeting was unclaimed.
The city has mowed the property two times this summer.
Clifford advised Slabaugh he may want to have the house boarded up.
The commissioner said the neighbors have reported creaking noises and they fear the house may be collapsing.
Clifford said it could be the neighbor's own house creaking and making noises or "it could be his knees if they're like my knees."
