ELKHART – Two Kosciusko County men were arrested on multiple charges at an Elkhart Walmart Wednesday morning.

At approximately 8:06 a.m. Wednesday, Elkhart County Sheriff’s Department officers responded to a complaint of suspicious persons in a vehicle in the Walmart parking lot at 30830 Old U.S. 20, Elkhart.

Officers found two male subjects in the vehicle with a handgun in plain view, according to an ECSD news release. Officers  learned that a third subject had entered the store, which prompted them to evacuate and search the building in an attempt to locate the individual.

Officers were not able to find the third person; store video confirmed that the subject already had left the premises, the release states.

Joseph P. Gerber, 37, Warsaw, was arrested and booked into the Elkhart County Correctional facility for unlawful possession of a police radio, a B misdemeanor; carrying a handgun without a permit, an A misdemeanor; obliterating identifying marks on a handgun, a felony; and conspiracy to commit armed robbery, a level 5 felony, according to the news release.

The second suspect, Seth Aaron Carlos Allen, 28, Claypool, had a warrant for his arrest from the Bureau of Alcohol, Tobacco and Firearms for a weapons-related charge and for dealing in methamphetamines. He was taken into custody by the ATF. Local charges for Allen, including conspiracy to impersonate a public servant and conspiracy to commit armed robbery, will be forwarded to the Elkhart County Prosecutor’s Office for further review.

Investigators continue to search for the third party involved in this incident.
