According to the probable cause affidavit, on Oct. 22, Kosciusko County Dispatch told a Kosciusko County Sheriff’s Office deputy of a standby for Department of Child Services at a hospital. The deputy spoke with the DCS agent and said the hospital contacted DCS regarding a minor. The deputy learned the minor suffered a broken arm, three fractured ribs on the left side and one fractured rib on the right, according to court documents.
The deputy spoke with Alexander who said she was asleep in the bedroom. The child was in a bassinet sleeping in the living room and Resendiz was on the couch in the living room. Alexander said she heard the child cry around 4 a.m. She went to the living room and changed the child’s diaper. She did not notice any injury at that time. She brought the child into the bedroom. About an hour later, Resendiz brought the child back into the living room. Resendiz watched the child and another minor while Alexander slept.

When Alexander woke up, she got ready for work and left for work. She said the child seemed comfortable and not fussy.
Around 3:30 p.m., Alexander said Resendiz messaged her about redness and swelling on the child’s arm and Resendiz believed it was a possible bug bite. Alexander left work and returned home and took the child to the hospital. Alexander said she had no clue the child was injured. The deputy saw the child’s right arm was red and swollen, according to court documents.
Resendiz took the other minor to the hospital for a medical evaluation and medical staff did not observe any injuries.
A Warsaw Police Department officer arrived on scene to help. The WPD officer spoke with Resendiz who said he woke up around 5 a.m. and noticed Alexander had taken the child into the bedroom. Alexander was laying on the bed holding the child. Resendiz then took the child back into the living room and didn’t notice any injury.
Resendiz said the child woke up around noon, and didn’t notice anything out of the ordinary with the child. When he took the child out of the swaddle, he noticed the child’s arm was red, and he showed Alexander the child’s arm. She came home and took the child to the hospital.
The detective spoke with Alexander who said around 4 a.m. she did hear the child cry for about 20 minutes so she brought the child into the bedroom. Resendiz then brought the child back into the living room about 5 a.m.
The child was taken to Riley Children’s Hospital for their injuries. With one of the fractures they sustained, medical staff determined it was a hard location on an infant’s body to sustain a fracture. Another of the child’s injuries was also determined to be specific to abuse.
Two areas of bruising on the child’s face was also inconsistent with Juarez Resendiz and Alexander’s explanations of how they sustained their facial injuries.
Riley Children’s Hospital medical staff ruled out Juarez Resendiz and Alexander’s responses related to how the child sustained the injuries, according to court documents.
