A Warsaw man was arrested for allegedly inappropriately touching a minor under the age of 14.
Earl E. Myers Jr., 49, of 2575 E. Center St., #112, Warsaw, is charged with child molesting, a level 1 felony; and child molesting, a level 4 felony.
He was booked into the Kosciusko County Sheriff’s Office at 7:24 p.m. Aug. 7 on a $50,250 preliminary bond.
According to the probable cause affidavit, on July 31 dispatch advised of a report of sexual misconduct with a minor.
A Warsaw Police Department officer spoke with a man and woman. The woman said the minor complained of pain to the babysitter that day.
The man said he dropped the minor off with a second woman on July 19. The man picked up the minor July 21.
The man said the minor’s babysitter helped the child with a bath. The minor told the babysitter that Myers had touched them inappropriately while at the second woman’s house.
On Aug. 2, the minor completed a forensic interview at the Bill Lewis Center in Laotto. The minor answered all questions to the best of their ability, according to court documents.
The forensic interviewer obtained a family history from the minor and told them the reason they were speaking was because people were afraid the minor was not safe and the minor’s body was hurt. The minor stated yes and lifted up their shirt and pointed.
The minor was shown images of a boy and girl and the minor circled the groin and buttocks area to specify the area where they were hurt. The minor said they told Myers no but Myers did not stop. The minor said it happened at the second woman’s house when the minor was 9 and 10 when they were out of the third grade and it occurred more than once.
A WPD detective contacted Myers who said he would take a polygraph test. Myers denied any wrongdoing and said he had kids of his own. On Aug. 7, Myers submitted to the polygraph test and the results showed Myers was deceptive when Myers was asked if he had touched the minor inappropriately.
The detective spoke with the babysitter who said, on July 31, the minor needed a shower and when the minor’s hand was near their groin, the minor cried and said Earl when they pointed.
