A Warsaw man was arrested after allegedly engaging in a sexual relationship with another person he knew he was related to.
Kevin Michael Newcomer, 40, of 8 EMS B61 Lane, Warsaw, is charged with incest, a level 5 felony.
He was booked into the Kosciusko County Jail at 3:22 p.m. Friday on a $10,250 preliminary bond.
According to the probable cause affidavit, on Nov. 8 a Kosciusko County Sheriff’s Office detective spoke with a woman who said she looked through Newcomer’s cell phone and located intimate messages between Newcomer and his relation that alluded to a sexual relationship.
Newcomer allegedly instigated conversations of a sexual nature with the relation after they turned 18 and asked to cuddle. Between May and October 2021, when the relation cuddled with Newcomer, the cuddling resulted in Newcomer and his relation having sex.
The relation said they had sex with Newcomer a few times.
Data recovered from Newcomer’s cell phone showed overtly sexual messages between Newcomer and the relation, along with nude images of both Newcomer and the person, according to court documents.
On Feb. 23, 2023, the detective obtained a search warrant for Newcomer’s DNA and collected it. On Feb. 28, 2023, the detective collected the relation’s DNA and sent them to the Indiana State Police Laboratory for DNA comparison.
The detective spoke with Newcomer on the phone and Newcomer declined an interview.
