Text messages allegedly led to a Warsaw man being shot on April 8 in Warsaw.

Michael Raul Ramirez, 18, of 540 E. Main St., Warsaw, is charged with aggravated battery, a Level 3 felony; intimidation with a deadly weapon, a Level 5 felony; two counts of pointing a firearm, Level 6 felonies, according to his probable cause affidavit filed  Thursday.

He was booked into the Kosciusko County Jail at 7:20 a.m. April 8 on a $5,250 preliminary bond.

Alonso Miguel Contreras, 21, of 3700 Shawnee Drive, Warsaw, also was arrested in connection to the case. He was booked into KCJ at 5:23 a.m. April 8 on a preliminary charge of felony battery with moderate injury. However, Contreras’ charing information document was not available as of closing of the Kosciusko County Justice Building on Thursday. His preliminary bond was $5,250.

According to the probable cause affidavit for Ramirez, on April 8 a Warsaw Police Department officer responded to a shooting on Baker Street. When the officer arrived at the scene, he saw a man with a gunshot wound laying on the ground near a silver BMW. A woman was providing first aid.

The officer saw another man, later identified as Contreras, and a second woman standing near the vehicle. The officer also saw a Taurus G3 9mm firearm on the front passenger seat of the vehicle. Brass knuckles were found in the back seat. The homeowner of the residence stated the shooter, later identified as Ramirez, was behind the house.

Another officer arrived to assist, located Ramirez and handcuffed him. Ramirez had an abrasion on the top of his head.

Emergency medical services arrived, aided the man with the gunshot wound and transported him to the hospital.

Ramirez, Contreras and the two women were taken to the WPD.

Contreras was read his Miranda rights and agreed to speak with law enforcement. He said on April 8, Ramirez hung out at a residence and Contreras did not approve. Ramirez was taken home. Ramirez allegedly sent Contreras messages and Contreras went to talk to Ramirez about them. Contreras knocked on the door and Ramirez looked out the glass pane and walked away.

Contreras walked toward the vehicle and Ramirez allegedly came out of the residence and pointed a gun at Contreras, a second man and the two women. Ramirez allegedly threatened to kill Contreras.

The second man and Ramirez exchanged words and the second man told Ramirez to put down the gun. The second man and Ramirez then allegedly physically fought and the gun  went off, hitting the second man.

Contreras was then able to take control of the firearm, made it safe and secured it in the vehicle, according to the affidavit. Ramirez then hit the man with the gunshot wound and didn’t provide any first aid.

Contreras then fought Ramirez and Ramirez then ran inside the residence. Ramirez came back out and Contreras pointed the gun at Ramirez and told Ramirez to get back in the house. Contreras allegedly threw a pair of brass knuckles on the roof of the residence.

Ramirez was read his Miranda rights and agreed to speak with law enforcement. Ramirez said he was hanging out with someone and Contreras was upset and sent Ramirez threatening messages. Ramirez said he was at his residence, looked outside and allegedly saw two people with their hoods up. Ramirez allegedly went to get a firearm and loaded it. He walked outside and pointed it once at them.

Ramirez told the second man to get back. The second man allegedly told Ramirez they were there to fight. When they were fighting, that’s when the gun went off. Contreras allegedly attacked Ramirez after the gun went off.

The second woman said Contreras received threatening messages from Ramirez and went over to the residence to talk to him. She said the door was knocked on and Ramirez came out of the residence with a firearm. The woman heard a gunshot. She said she saw Ramirez wave the firearm around threatening to shoot again. The second woman made the 911 call when the second man said he was shot.

An officer spoke with the man with the gunshot wound who said when Ramirez came out of the residence, he said he does not fight, he shoots. The man told Ramirez to put the gun away several times and Ramirez allegedly threatened to kill the man. The man said he was getting back in the car when he was shot in the back.

An officer spoke with the first woman and said when Ramirez came out of the residence, he verbally argued with Contreras. The man got of the vehicle, the argument escalated and the man was shot.

On April 11, an officer conducted a search of Contreras’ phone. A video was taken from the scene of the fight which allegedly showed Ramirez holding a flashlight in one hand and the firearm in the other. Contreras and Ramirez yelled and Ramirez threatened the man and Contreras, according to the probable cause affidavit.
