CITY OF NAPPANEE PLAN COMMISSION

    The City of Nappanee Plan Commission will hold a Public Hearing on April 13, 2023, at 7:00 pm in the Council Chambers at the Nappanee City Municipal Center, 300 W. Lincoln Street, Nappanee, Indiana.

    The purpose of the Public Hearing is to hear Petition #05-23-PLN to Rezone from I1-Industrial to B2-General Business, Lot #2 of O’Reilly Minor Subdivision at 1755 E. Market Street by Anthony Cocca of Cocca Development (Developer) and Shepard Land Investments, LLC (Property Owner).

    LEGAL DESCRIPTION OF PROPERTY:

    A CERTAIN PORTION OF LAND SITUATED IN THE SOUTHWEST QUARTER OF SECTION 32, TOWNSHIP 35 NORTH, RANGE 5 EAST, SECOND P.M., NAPPANEE, ELKHART COUNTY, INDIANA, BEING A PORTION OF LOT 2 AS SHOWN PER O'REILLY MINOR SUBDIVISION RECORDED IN PLAT BOOK 38, PAGE 18, OFFICIAL RECORDS ELKHART COUNTY, SAID LAND BEING ALSO DESCRIBED BY THE METES AND BOUNDS DESCRIPTION TO FOLLOW:

    BEGINNING AT A FOUND 5/8" REBAR LOCATED ON THE SOUTH RIGHT-OF-WAY LINE OF EAST MARKET STREET A.K.A. UNITED STATES HIGHWAY 6 (A 60' PUBLIC RIGHT?OF?WAY) AT THE NORTHWEST CORNER OF SAID LOT 2;

    THENCE NORTH 89 DEGREES 40 MINUTES 22 SECONDS EAST ALONG SAID SOUTH RIGHT-OF-WAY LINE, ALSO BEING THE NORTH BOUNDARY LINE OF SAID LOT 2, A DISTANCE OF 177.70 FEET;

    THENCE DEPARTING SAID RIGHT-OF-WAY LINE SOUTH 00 DEGREES 06 MINUTES 09 SECONDS EAST A DISTANCE OF 359.26 FEET TO A POINT ON THE SOUTH BOUNDARY LINE OF SAID LOT 2;

    THENCE SOUTH 89 DEGREES 40 MINUTES 22 SECONDS WEST ALONG SAID SOUTH BOUNDARY LINE A DISTANCE OF 177.70 FEET TO A FOUND 5/8" REBAR LOCATED ON THE WEST BOUNDARY LINE OF SAID LOT 2;

    THENCE NORTH 00 DEGREES 06 MINUTES 09 SECONDS WEST ALONG SAID WEST BOUNDARY LINE A DISTANCE OF 359.26 FEET TO THE POINT OF BEGINNING, CONTAINING AN AREA OF 63,839 SQUARE FEET OR 1.466 ACRES MORE OR LESS.

    A copy of such proposal is on file in the office of the City Planner of the City of Nappanee, Indiana, City Municipal Building, 300 W. Lincoln St., Nappanee, Indiana. Written objections that are filed with the office of the City Planner of the City of Nappanee before the hearing will be considered.

    All concerned citizens will be offered the right to speak and voice their comment at the Public Hearing. The Public Hearing may be continued from time to time as may be found necessary.     

    Anyone who requires an auxiliary aid or service for effective communication, or a modification of policies or procedures to participate in a program, service, or activity of the City should contact the Office of the City Clerk-Treasurer, 300 West Lincoln Street, Nappanee, Indiana 46550, (574)773-2112, [email protected] as soon as possible, but no later than 48 hours before the scheduled event.
