Teen Arrested On Rape, Sexual Misconduct Charges

A Warsaw man was arrested after allegedly raping a 14-year-old.
Branden Andrew Miller, 19, of 1403 E. Market St., Warsaw, is charged with rape, level 3 felony; sexual misconduct with a minor, a level 5 felony; and criminal confinement, level 5 felony.
He was booked into the Kosciusko County Jail at 5:09 p.m. Thursday on a $25,250 preliminary bond.

According to the probable cause affidavit, on Feb. 17 a Warsaw Police Department officer was investigating an incident when the officer was made aware a minor was possibly a victim of sexual assault. A forensic interview with the minor was conducted at Safe Harbor Child Advocacy Center.
During the interview, the minor was asked what they were there to talk about and the minor replied about Miller. The minor said they were at their friend’s house in August when they were 14. The minor said Miller drove to the person’s house with someone else and they planned to go to the skating rink. They instead went to an area store and purchased items and returned to Miller’s vehicle.
The two people Miller and the minor were with exited the vehicle and Miller drove to a darker part of the parking lot. The minor alleged Miller removed the minor’s seatbelt and tried to pull them on him. The minor allegedly said no several times. The minor then alleged Miller forcibly had sex with them, according to the affidavit.
Afterward, Miller picked up the two people that exited the vehicle and he dropped off the minor and their friend at the skating rink.
The minor said they told their friend about the incident and Miller told them initially he was 16. When Miller asked the minor’s age, they said they were 14. Prior to the incident, the minor said they had never met Miller before.
A WPD officer interviewed the friend on Feb. 21. The friend said the minor went to the skating rink and found Miller and the other person. After leaving the rink, they went to the store. The friend and the second person left the vehicle and Miller went to another part of the parking lot. Miller picked the friend and the second person up five or 10 minutes later and took them to the skating rink. The minor then allegedly told the friend about the sexual assault.
The officer interviewed the second person and they said the four drove around and stopped at a store and hung out in the parking lot. The second person and the friend at one point got out of the vehicle and Miller drove the minor to a different spot in the parking lot.
The officer interviewed Miller who said, “Needless to say, we did stuff together. I will tell you that flat out,” according to the affidavit.
Miller said the minor told him they were 16 or 17. They ended up at the store and the friend and second person got out of the vehicle. Miller said he and the minor talked. He said things escalated, but it was consensual.
