Warsaw Man Faces Rape, Domestic Battery Charges

A Warsaw man was arrested after allegedly raping and battering a person.
Kevin Rodriguez Duran, 27, of 548 E. Main St., Warsaw, is charged with rape, a level 3 felony; criminal confinement, a level 5 felony; strangulation, a level 6 felony; domestic battery with a child under 16 present, a level 6 felony; and criminal mischief, a class B misdemeanor.
He was booked into the Kosciusko County Jail at 2:37 a.m. Saturday on a $20,250 preliminary bond.
According to the probable cause affidavit, at about 12:46 a.m. Saturday, the Kosciusko County 911 Communications Center dispatched officers to a residence in reference to a domestic incident. A Warsaw Police Department officer responded and spoke to a person who said they were assaulted by Rodriguez Duran. Officers saw the person had a swollen and bloody lip.
The person stated they were lying in bed with two minors when Rodriguez Duran came into the room intoxicated. The person said Rodriguez Duran gave the children cell phones to keep them busy and then attempted to be intimate with the person. The person told Rodriguez Duran they didn’t want to have sex and Rodriguez Duran didn’t listen to them. Rodriguez Duran then forced himself on the person.
Rodriguez Duran began to choke the person and eventually stopped when the person said they didn’t feel well.
When Rodriguez Duran went to get the person water, the person tried to leave the bedroom. Rodriguez Duran asked where they were going and forced himself on them again, according to court documents.
The person attempted to grab their phone and Facetime their mother. When Rodriguez Duran saw that, he allegedly slapped the phone out of their hand, hitting their face and causing the phone to fall. Rodriguez Duran then picked off the phone and slammed it on the floor.
For a brief time, the Facetime was connected the person’s mother saw the assault and called 911.
Officers spoke with Rodriguez Duran outside the residence. Rodriguez Duran said he had gotten home from work and was outside drinking a few beers. He said he tried to have sex with the person and said the person wanted sex at first and later didn’t. He denied touching the person when asked about the physical fight.
According to court documents, Rodriguez Duran appeared intoxicated and was slurring his speech. He submitted to a portable breath test, which returned a positive result for ethanol and a BrAC of 0.13%
