A Mentone man was arrested after allegedly pointing a gun at several people and then shooting the gun in the air.
Roy Daniel Case, 69, of 5807 W. Hummingbird Drive, Mentone, is charged with criminal recklessness with a deadly weapon and pointing a firearm, both level 6 felonies.
He was booked into the Kosciusko County Jail at 8:48 a.m. Aug. 3 on a $10,250 preliminary bond.
According to the probable cause affidavit, on Aug. 3 dispatch advised of shots fired at a residence. The woman who called dispatch said Case pointed a gun at her residence and fired shots in the air.
A Kosciusko County Sheriff’s Office deputy and a Mentone Police Department officer responded to the scene and observed a relative of Case’s arrive. The relative said he arrived at the residence to help calm Case down. The relative stated he didn’t know what started the incident but did know Case allegedly shot a gun into the ground.
The woman said she and her brother and son store a race car on their property and had pulled it out of the barn to clean it. The woman said Case then exited his residence, cursed and was getting mad at them. Case then went to his vehicle, turned on music and then went back inside his residence.
The woman’s son then started the vehicle again and Case exited his residence with a gun, pointed it in the direction of the woman and her son and then fired two shots in the air. Case then went back inside his residence.
Officers attempted to have Case exit his residence. The relative said Case was passed out due to alcohol consumption and the relative allowed the officers into the residence. Officers located Case, observed signs of impairment and attempted to stand him up, according to court documents.
Case allegedly refused to stand up, tensed up and held his arms by his chest. Case then pulled his right arm away from law enforcement, balled his fist and attempted to strike one of the officers. Case was handcuffed and placed in a police vehicle.
Another officer assisted the KCSO deputy with a search and located a 9mm bullet shell casing near the front door and two shell casings near the ground near a deck on the property.
An officer secured a 9mm handgun loaded with a full magazine and chambered round.
