Editor, Times-Union:

Yesterday (4/26/23), we received a “Vote for Heather James” mailer sent to “Local Postal Customer” at our home in Winona Lake.

It came to my attention that there is no disclaimer on the piece. Upon reviewing the Indiana Code regarding distribution of political material, IC 3-9-3-2.5 states that a direct mailing piece “must contain a disclaimer that appears and is presented in a clear and conspicuous manner to give the reader or observer adequate notice of the identity of persons who paid for and, when required, who authorized the communication ...” Further, IC 3-14-1-3 states that the penalty for circulating or publishing literature or other material concerning a candidate without the required disclaimer “is a Class A misdemeanor, up to a $5,000 fine or 1 year in jail or both.”

Seems the Heather James camp overlooked this detail. As I see it, God’s people are human, we all make mistakes.
