A Pierceton woman is facing charges after police went to execute an eviction notice and found an injured dog.

Elaina Rochelle Howard, 41, of 196 N. CR 850E, #1079, Pierceton, was booked in the Kosciusko County Jail at 7:43 p.m. Friday and charged with a Class A misdemeanor for cruetly to an animal.

Also pending in the court system for Howard are two charges of fraud, Level 6 felonies; and theft, a Class A misdemeanor.

In the animal cruelty case, according to the police report at 4 p.m. April 2, Kosciusko County Sheriff’s Office deputies went to Howard’s Pierceton residence to see that Howard moved her personal property to a barn after she was evicted.

While there, according to the report, police observed a dog that had a steel cable wrapped several times around its rear leg. The cable was embedded in the dog’s leg and the leg was swollen, the report states. Furthermore, the dog did not have shelter and was not able to stand, according to the report.

When police pointed out the dog’s condition to Howard, she allegedly said, “It wasn’t too bad,” and said the dog belongs to her 9-year-old daughter.

Officers were able to cut the steel cable off of the dog, but the dog was still not able to stand, according to the report.

Howard had previously been cited by law enforcement for the dog trying to attack chickens at a neighboring property and was given a ticket for an unrestrained dog.

Howard was instructed to seek veterinary care for the dog as soon as possible, according to the report.

She also had an open case in Kosciusko Superior Court II stemming from a Jan. 20 incident where a woman told police there were fraudulent charges on bank account.

According to the probable cause affidavit filed in that case, the woman said she began noticing mail was missing from her mailbox including her debit card, Social Security card and gift cards. The woman said she was suspicious of the neighbors.

The two purchases made on the debit card were ATM withdrawals that totaled $406, according to the affidavit. An attempt to use the bank card occurred on Jan. 17 at Four Winds Casino, according to court papers.

Police spoke with Four Winds Casino management and were able to obtain video surveillance and a copy of the driver’s license for the person who had been playing a game that required identification, according to the affidavit.

That driver’s license and surveillance allegedly shows Howard as the person at the casino.

When police spoke with Howard, according to the affidavit, she said the debit card was left in her mailbox so she took it and used it to make two ATM withdrawals without permission. She further allegedly admitted trying to use the card at the casino.

Her bond was set at $6,250.
