After Prison Release, Man Faces New Charges

A Warsaw man released from a six-year prison term in August for battering a child is facing charges in four new cases.

Bradley Victor Waikel, 32, of 340 E. Levi Lee Road, lot 123, Warsaw, was booked in the Kosciusko County Jail at 7:44 p.m. Tuesday.

According to Indiana Department of Correction records, Waikel was released from a six-year prison sentence Aug. 31.

Kosciusko Superior Court I Judge Duane Huffer sentenced Waikel to prison on Nov. 14, 2013, after he was convicted of a Class C felony battery charge. In April 2013, Waikel was arrested and charged with beating his girlfriend’s 2-year-old son while she was at a job interview.

According to court papers in the case, the child was taken to Riley Hospital for Children for his injuries that included skull fractures and an extensive injury in the groin area. Police believe Waikel used a kitchen utensil to beat the boy.

On Tuesday, when Waikel was arrested, he was wanted on a warrant for felony failure to appear from a case he picked up less than a month after he was released from prison on Sept. 16.

According to the probable cause affidavit, on Sept. 6 Warsaw police were dispatched to a local supermarket where Waikel worked after employees found a backpack that allegedly contained drugs and belonged to Waikel.

The employees found the backpack on the loading dock and went through the backpack to attempt to learn who it belonged to, according to court papers.

Waikel denied to police the backpack was his, according to court papers, however, he allegedly phoned the two employees and demanded the backpack be returned to him.

According to the affidavit, video surveillance showed Waikel entered the store with the backpack and was the only person to have touched the backpack except for when the employees took possession of the bag. Inside, police allegedly found 2.5 grams of methamphetamine, a schedule III controlled substance Sublingual pill and a vaping device that contained a brown liquid that tested positive for marijuana.

Waikel is charged with possession of methamphetamine, a Level 6 felony; possession of a controlled substance, a Class A misdemeanor; possession of marijuana, a Class B misdemeanor; and possession of paraphernalia, a Class C misdemeanor.

Waikel failed to show up to court for a hearing in the matter, and a warrant was issued for his arrest.

His Tuesday arrest also stems from a case filed against him Feb. 15 in Kosciusko Superior Court II, where he is accused of battering a woman on Dec. 13.

According to the probable cause affidavit, the victim’s mother called police and said Waikel had just battered her daughter.

Upon arrival, police spoke with the victim who said she lives in the home and Waikel lives there on and off and that an argument had started earlier in the day.

According to the affidavit, during the argument, Waikel allegedly threw a box of perfume in the direction of the woman’s small child, which escalated the argument.

The woman told police she went into the bedroom with Waikel and Waikel placed his forehead onto hers in a threatening manner, then choked her, making it difficult for her to speak or breathe.

Waikel then allegedly demanded the woman’s phone, and when she refused to give it to him, according to court papers, he grabbed her arms and pulled them backward, causing her to drop the phone.

Waikel then left with the woman’s phone, valued at $175, according to the affidavit.

Police reported observing bruises on the woman’s arms. They spoke with the child in the home who, due to the child’s young age could not describe in detail what occurred. The child was able to say Waikel hurt the woman, according to the affidavit.

For this case, Waikel is charged with strangulation, a Level 6 felony; domestic battery with a child under 16 present, a Level 6 felony; domestic battery, a Class A misdemeanor; and theft, a Class A misdemeanor.

Waikel further is facing one Class B and one Class A misdemeanor charge in two separate filings for allegedly kicking in the door of the victim’s residence on two separate occasions.

His bond was set at $5,250 for the strangulation arrest, but no bond was set for his felony failure to appear arrest.

No-contact orders were issued.
