Man Arrested After Allegedly Firing Gun On Greenway While Intoxicated
By Amanda Bridgman-
Shane Michael Ostendorf, 34, of 626 Nancy St., Warsaw, was booked in the Kosciusko County Jail at 8:46 p.m. April 26 and charged with criminal recklessness while armed with a deadly weapon, a Level 6 felony; and carrying a handgun without a license, a Class A misdemeanor.
According to the probable cause affidavit filed Friday in Kosciusko Superior Court I, on April 26 Warsaw police were dispatched to the Greenway Trail by Kosciusko Community Hospital in Warsaw after a caller said a man wearing a gray shirt, who was with a woman and child, had a gun on the trail and had fired shots.
Police began canvassing the trail and located a person matching the caller’s description, later identified as Ostendorf.
When police approached the trio, according to court papers, the adults told police they, too, had heard the shots.
However, according to the affidavit, police observed a bulge near the waistband of Ostendorf’s pants and located a 9mm handgun, loaded with 10 bullets.
Ostendorf then allegedly admitted to firing the handgun, and police located three spent shell cases from the handgun, a tree that had three bullet holes in it and there were cabins and boat docks behind it.
Officers later located six more spent shell casings in the area as well as two bullets that had not been fired.
According to the affidavit, during the conversation with Ostendorf, his speech seemed slurred and his balance shaky. A breathalyzer test result came back at .018%, and Ostendorf was then taken to the county jail.
His bond was set at $5,250.
