Man Faces Domestic Battery Charges In 2 Cases

A Warsaw man is facing domestic battery charges in two separate cases after allegedly battering a woman in front of children.

Michael J. Kabala Jr., 45, of 580 Nuthatch Drive, Warsaw, was booked in the Kosciusko County Jail at 5:18 p.m. Thursday and faces charges for domestic battery with a child under 16 present, a Level 6 felony; strangulation, a Level 6 felony; and invasion of privacy, a Class A misdemeanor.

According to the probable cause affidavit filed in that case Dec. 29 in Kosciusko Superior Court II, on Nov. 26 Kosciusko County Sheriff’s Office deputies responded to a home in reference to Kabala battering a woman and that a no-contact order was in place.

Upon arrival, police spoke with the woman who said Kabala had found out she was seeing another person and was upset, so he broke into the laundry room of the home and began to batter her.

According to court papers, the woman said Kabala picked her up and carried her in a headlock, which prevented her from breathing. She further told police she was worried she was going to pass out because she could not breathe as Kabala dragged her to the living room. Once in the living room, the woman said Kabala slammed her against a door frame, striking the back of her head, and gave police a clump of her hair she said Kabala pulled out.

The woman said Kabala also took her cell phone and would not return it, so she fled to her car to get away and went to a neighbor’s who called police, according to court papers.

Police spoke with two children in the home who said they saw Kabala fight and choke the woman, according to the affidavit.

According to court records, Kabala has a pending case against him that was filed Oct. 5 after an incident on Aug. 12 where he’s accused of battering the same woman.

In that case, according to court papers, police showed up and could hear Kabala yelling inside the home from the driveway. Upon entering the home, the woman told police Kabala had lost his temper and was in the home breaking things and hitting her.

Police observed pasta on the floor, a stuffed animal that had sauce all over it and a broken vacuum near the pasta, according to the affidavit. The woman told police Kabala had grabbed her by her hair, thrown her to the ground and kicked her in front of the children.

A no-contact order was put in place after that altercation, according to court records.

Kabala’s bond was set at $5,250.
