Robert Wayne Barnett, 29, of Garrett, was booked in the Kosciusko County Jail at 4:29 a.m. Dec. 4 and faces charges for intimidation with a deadly weapon, a Level 5 felony; pointing a firearm, a Level 6 felony; possession of methamphetamine, a Level 6 felony; and possession of paraphernalia, a Class C misdemeanor.
According to the probable cause affidavit filed Dec. 29 in Kosciusko Circuit Court, at 2:34 a.m. Dec. 4, sheriff’s deputies were dispatched to an area for a report of someone pointing a gun.
Upon arrival, deputies discovered Syracuse Police had already arrived and had two individuals involved in the incident with them.
According to court papers, three men, including Barnett, were interviewed by police.
Barnett told police he came to the area to pick up one of the men involved in the argument.
The first man told police he went to the laundry room in the building and found a couple engaging in sexual conduct, according to the affidavit. The man said he left and came back with a second man, and a verbal argument ensued between the two men and the couple.
During this verbal argument, according to court papers, Barnett showed up, pointed a gun at the first and second man and ordered them back to their rooms.
When police spoke with Barnett again, he denied pointing a gun but gave consent for police to search his vehicle. Police discovered methamphetamine and a smoking device in his vehicle, and Barnett was arrested, according to court papers.
Upon interviewing others at the scene, all of them told the same story about Barnett showing up and pointing the gun. Another tenant in the building told police he heard a commotion, went outside and saw the argument and Barnett pointing the gun.
Another person told police Barnett may have given the gun to another person. When police located that person, according to court papers, the man admitted Barnett gave him the gun.
The gun was a Rock Island Armory M1911 A1-F2 .45 caliber handgun that was loaded with a bullet in the chamber, according to court papers.
His bond was set at $5,250.
