A crash in downtown Warsaw Tuesday injured two and landed one man in jail for drinking and driving.

At 5:43 p.m. Tuesday, Warsaw police officers responded to a wreck at the intersection of West Center and North Union streets.

The investigation determined that Wilmar A. Hernandez-Rosales, 48, of North Union Street, Warsaw, was driving a blue 2008 Kia Sedona south on North Union Street when he disregarded the stop sign at the intersection.

That disregard resulted in Rosales’ vehicle smashing into a white 2013 Toyota Prius, being driven by Christopher A. Maron, 25, of North First Street, Pierceton. The impact to the driver’s side of Maron’s car resulted in the car being pushed over the curb, according to the crash report.

Maron was taken to a local hospital for complaint of neck pain.

Rosales, however, told police at first that he was driving but later said he not only wasn’t driving but he was never even in the vehicle. Witness accounts proved otherwise, along with a passenger of Rosales’ that had left the scene on foot after the crash. That passenger, Julio Domingas-Torres, 34, of North Union Street, Warsaw, reappeared at the scene and told police he was driving but the brakes failed. Torres then told police he was not driving and that Rosales was the driver.

According to witnesses at the scene, one man told police that Rosales was the driver and he attempted to get out after the crash. The witness said he told Rosales to stay in the vehicle, and then Rosales crawled into the back seat.

Rosales was taken to Kosciusko Community Hospital for treatment of neck pain and a blood draw for an operating a vehicle while intoxicated investigation. Rosales was booked in the Kosciusko County Jail at 9:40 p.m. Tuesday for an OWI charge. His bond was set at $700.

Both vehicles had to be towed from the scene. Estimated damage is between $10,000 and $25,000.
