Winona Lake Ice Rink Proposals

NOTICE OF REQUEST FOR PROPOSALS – CONSTRUCTION AND OPERATION OF AN ICE RINK, TOWN OF WINONA LAKE, INDIANA

    This Request for Proposals (the “RFP”) is issued by the Winona Lake Redevelopment Commission (the “RDC”), for and on behalf of the Town of Winona Lake, Indiana (the “Town”), for the purpose of seeking proposals from qualified developers for the development, construction, and operation of an ice rink and multipurpose pavilion to be owned by the RDC (the “BOT Project”).    This developer shall enter into an agreement with the RDC and the Town for the BOT Project (the “Agreement”). The RDC invites proposals from developers capable of providing the specialized, professional services required for construction and operation of the BOT Project.

    The RDC desires to obtain high-quality services and facilities that meet the needs of the community of Winona Lake. The intent of this RFP is to engage a developer that is deemed most responsive in providing such services as a contractor of the RDC and the Town. Specifically, the RDC seeks an operator that will:

    1. design, construct, operate and maintain an ice rink and multipurpose pavilion within ? mile of the town hall located at 1310 Park Ave, Winona Lake, IN 46590. The distance requirement allows for the continuity and continued walkability between the BOT Project and Town’s primary public attractions and amenities.

    2. the initial cost of the Construction shall be partially or entirely the responsibility of the operator;

    3. the agreement must identify which costs are to be the responsibility of the operator and which costs are to be the responsibility of the Town.

    4. work cooperatively with all landowners involved with the location of the BOT Project;

    5. properly maintain and safeguard the Town’s investment through the exercise of highest standards of maintenance in accordance with RDC requirements and, where approved by the RDC, recommend or undertake capital improvements to improve BOT Project in order to maximize the economic impact to the Town;

    6. implement appropriate marketing activities to attract new customers to be utilize the BOT Project;

    7.   accomplish all objectives required of the operator in a professional manner, in compliance

with best practices and applicable laws and ordinances;

    8. work in cooperation with other community stakeholders and the public at large to ensure equal access to the BOT Project; and

    9. at a certain period of time, the RDC would assume ownership of the BOT Project and real estate and pay a purchase price in one lump sum or over a period of time.

    In order to satisfy the RDC’s requirements and meet the RDC’s goals mentioned above, proposers must agree to provide all of the services sought by the RDC under this RFP. At the conclusion of the RFP process, and upon the execution of a Build Operate Transfer Agreement (the “BOT Agreement”) among the selected proposer, the RDC and the Town, the selected proposer will have responsibility for the operation of the BOT Project for a determined period of time.  This process is governed by IC 5-23. The BOT Agreement must provide for the payment of contractors and subcontractors under IC 4-13.6-7, IC 5-16-5, or IC 36-1-12, whichever is applicable.

    Information to be Included in Proposals

Proposals should include a written description of the Developer’s experience planning, designing, financing, constructing, operating, transferring, and marketing similar projects, as well as the following:

1. Cost

    a. The cost to the RDC to purchase the real estate and all equipment and improvements, including a guaranteed maximum price and the term and interest rate on any proposed financing.

    b. Identify expenses to be paid by the RDC and the developer c.    The overall value of the project

2. Project Specifics:

    a. Overall site plan for the BOT Project including any preliminary architectural or engineering design work that has been completed prior to submission.

    b. Overall map of the town showing the BOT Project proposed location to ensure the Developer meets the requirement that the Project be located within 1/2 mile of the town hall located at 1310 Park Ave, Winona Lake, IN 46590.

3. General Information

    a. Developer’s general information including company name, principal office location, point of contact, and contact information

    b. Company overview, organization information, and organization chart

    4. Similar Development Experience

    a. Experience working with local economic development organizations and local government units, including those in Indiana

    b. A list of similar completed projects with descriptions and references

5.   Financial Capacity:

    a. General financial and credit information b.   Credit rating and bonding capacity

c.    Information indicating financial ability of the developer to complete the project d.   List of credit references

6. Project Approach

    a. Outline of duties and responsibilities of all parties to the development project from start until final sale to the town

    b. Outline of project timeline including critical path activities

    c. A commitment from the developer to use local contractors when cost competitive

Anticipated Selection Process

    The RDC will review all proposals and may enter discussions with offerors to clarify and assure a full understanding of proposals.   All offerors will be accorded fair and equal treatment with respect to any opportunity for discussion and revision of proposals. After receipt of the best and final offers from offerors, the RDC will make a recommendation for award of an agreement based upon compliance with the above-requested design specs, as well as price, schedule, and other terms or shall terminate the request for proposal process.

    Of all evaluation criteria listed in this Request for Proposals, overall project value, cost and financing terms will be given the most weight by the RDC. The RDC reserves the right to modify or cancel this project at any time before a developer enters into a formal agreement with the RDC.
