This is the second part to my proposed amendment on allowing the states as a whole the right to veto various acts by the federal government. The first part was printed in the April 28 edition of the Times-Union. The passage of this amendment would provide an additional tool for checks and balances between the states and the federal government along with the current ones that states have such as Article V constitutional amendment process or constitutional convention. There is also the ability by the states to sue the federal government in the courts but this has limitations. Finally, there is also the need for some type of restoration of pre-17th amendment U.S. senators directly elected by state legislatures.
Proposed Constitutional Amendment (Group Veto) Continued
Section 1 - Group Veto - Basic Principle
The states as a whole shall have the authority to veto any part or whole of an executive order signed by the president, a legislative act passed by Congress, a Supreme Court ruling, an international treaty ratified by the Senate or regulations issued by a federal bureaucratic agency and the enforcement by the federal government of any decree, law or regulation approved by any international or transnational authority made after the ratification of this amendment unless such an act of group veto infringes upon the natural and constitutional rights of the citizens and inhabitants of the United States and its territories.
Section 2 -?Group Veto - Majority Of States Necessary For Passage Of An Act Of Group Veto Throughout The Whole Union
The approval of a two-thirds majority (33) of the total state legislatures of the Union shall be necessary to veto any part or whole of an executive order signed by the president, a legislative act passed by Congress, a Supreme Court ruling, an international treaty ratified by the Senate or regulations issued by a federal bureaucratic agency throughout the whole Union.
Section 3 - Group Veto - Threshold For Passage In Individual State Legislatures
A three-fifths majority vote in favor of an act of nullification or group veto shall be necessary to pass such an act in each individual state legislature.
Section 4 - Group Veto - Time Limit For Approval Of An Act Of Group Veto
An act of group veto passed by a two-thirds majority (33) of the state legislatures must be approved with a seven-year time frame.
Section 5 - Group Veto - When Does The Time Limit For Approval Of An Act Of Group Veto Start
The seven-year time limit for an act of group veto to be passed by the various state legislatures shall begin immediately after the signing of the executive order, the passage of the legislative act, release of the judicial ruling, ratification of the treaty or the issuance of the bureaucratic regulation.
