Mentone Woman Gets Six Years For Child Molesting

A Mentone woman was given a six-year sentence Thursday for child molesting.

Jasmine Sue Davis, 19, of 204 N. Franklin St., Mentone, appeared Thursday in front of Kosciusko Superior Court I Judge David Cates and was sentenced to six years in the Indiana Department of Corrections for a Level 4 felony child molesting conviction. Two of those years were suspended to formal probation, and Davis was given until Thursday to get accepted into the Michiana Community Corrections program, otherwise she will have to turn herself in to the Kosciusko County sheriff for transport to IDOC.

Davis also must register as a sex offender upon her release and is not allowed to be around any child under the age of 18 unless that child’s parent is physically present.

Davis was arrested in October after police received a report from Child Protective Services that Davis had sex with a child under 14 years old.

In court Thursday, Davis’ attorney, Adam Turner, told the judge his client is emotionally immature and that this case is unique because of what happened. Turner said Davis had a relationship with the victim online and that when the relationship began, Davis was a minor. However, Davis turned 18 and that relationship also began becoming more face-to-face and that is when Turner said Davis learned the victim’s true age.

“She lacks emotional maturity,” Turner said. “That’s not an excuse. She is not a predator. She’s an immature adult who didn’t do the right thing and walk away.”

Turner also told Cates his client has no criminal history, has undergone counseling since her arrest on her own free will, has a strong family support network and has remained employed throughout the case. Turner asked the judge to suspend Davis’ sentence to formal probation or community corrections.

“I know I messed up,” Davis said in a statement to the court. “I’m willing to accept what I did. I should have walked away, and I didn’t. I’m fresh out of school, and I plan on going to college.”

“Let me be very clear about this. ... This is on you,” Cates told her. “That was a poor choice, but it’s on you, not on the victim.”

Davis is also to have no contact with the victim of the case.
