Jason D. Miller, 33, of 1503 N. Fox Farm Road, Warsaw, was booked in the Kosciusko County Jail at 9:06 a.m. Wednesday and faces charges for battery causing bodily injury to a law enforcement officer, a Level 5 felony; and intimidation to a law enforcement officer, a Level 6 felony.
According to the probable cause affidavit filed March 24 in Kosciusko Superior Court III, on March 12 KCSO Sgt. Michael Fowler and Deputy Tyler Stringfellow responded to a residence for an out-of-control person.
Upon arrival, the deputies approached the residence and could hear a man yelling, “They will all burn by the demons,” along with other disturbing comments. The man also was yelling he would “kill them,”?according to the affidavit.
The deputies entered the residence through a door being held by a woman and located Miller in the kitchen. Miller immediately began yelling at the deputies, according to court papers, and said, “I have a gun and I am not scared to use it.”
Miller then ran and “battered Sgt. Michael Fowler by stricking him in the face and forehead,” the affidavit reads. Court papers also state that during this altercation, Stringfellow tased Miller, to no effect, and Miller continued to fight and strike Fowler in the face.
Upon restraining Miller, police found a loaded .45 caliber pistol with a bullet in the chamber and cocked and ready to fire in a holster on Miller’s back, according to the affidavit. They also found a large knife on the right hip of Miller.
Even after being restrained, Miller continued to yell that he was going to kill everyone there and burn the house down, according to the affidavit.
Fowler sustained cuts, swelling and bruising from the altercation with Miller, court papers state.
