Special Prosecutor To Review Charges Against Ingle

ROCHESTER – A special prosecutor will review if battery charges will be filed against Brittany Ingle, the mother whose three children were killed by Alyssa Shepherd in October 2018.

Ingle was arrested following Shepherd’s Dec. 18 sentencing in Fulton Superior Court. Shepherd received a 10-year sentence, with four years executed in the Indiana Department of Corrections, for killing Ingle’s three children and seriously injuring a fourth child as the students boarded a bus.

According to the probable cause affidavit filed Tuesday in Fulton Superior Court, after the sentencing court security deputy Walker Conley was walking Shepherd to exit the courtroom to be taken to the Fulton County Jail. As Shepherd was escorted past the family of the victims, Ingle rushed past police and attacked Shepherd. Court papers state Ingle struck Shepherd’s head with her hand/elbow, causing Shepherd’s head to hit the courtroom wall.

Ingle was apprehended by police and taken to a jury room while Shepherd was escorted out. While in the jury room, Ingle said, according to the affidavit, “I f***** up, didn’t I?”

Shepherd was taken to Woodlawn Hospital in Rochester, where she got a CT scan and then was medically cleared. Shepherd suffered no injuries, the affidavit states.

Ingle was booked in the Fulton County Jail and preliminarily charged with misdemeanor battery.

On Wednesday, the Fulton County Prosecutor’s Office said due to the closeness of the case, a special prosecutor will be assigned to review if formal charges will be filed.  

Ingle was released on her own recognizance.
