Sutton Withdraws From Superior II Race, With An Apology

Judge Joe Sutton is publicly apologizing for comments he made about Judge Torrey Bauer and withdrawing his candidacy for Superior Court II judge.
Sutton is the sitting judge in Kosciusko Superior Court III and announced Monday he is not retiring as many people assumed, but instead had filed to run against Kosciusko Superior Court II Judge Bauer.
In Sutton’s interview Sunday with the Times-Union announcing his candidacy, Sutton claimed his work ethic was different than Bauer’s work ethic and cited a controversial order Bauer enforced that sent a woman to jail for contempt for 21 days.
Bauer responded by calling Sutton uninformed, mistaken and inappropriate.
On Tuesday, Sutton said, “During the course of a telephone interview Feb. 2 with Times-Union reporter Amanda Bridgman, I made reference to a court case and its outcome that has created a controversy that could affect the outcome of the judicial primary election for Superior Court 2. My comments were outside the traditional pillars of experience, integrity, fairness and impartiality. It was wrong, and it was no fair to Judge Bauer. To avoid a cloud of controversy in this primary election, today (Tuesday) I filed with the Indiana Election Division, form (Can. 10) 2020 Primary Election Candidate Withdrawal. I am no longer a candidate for judge of Superior Court 2 in the Republican primary election to be held on May 5. I offer my public apology to Judge Bauer and wish him continued success in Superior Court 2.”
In response to learning of Sutton’s withdrawal and apology, Bauer said, “I have been informed that Judge Sutton had withdrawn his candidacy. I am thankful as judicial campaigns, or any for that matter, are extremely taxing and difficult and I have the utmost respect for anyone who pursues public office. Judge Sutton has served this county and its residents as a deputy prosecuting attorney and then as the only judge this county has known in Superior Court III for 24 years. His service to the county is beyond reproach as is his character. I have always counted Judge Sutton a friend, and I continue to do so. I look forward to working with Judge Sutton for the remainder of his term and, of course, wish him the best in his retirement.”
Sutton has been the presiding judge since Jan. 1, 1997; Bauer was elected to Superior II five years ago and is seeking re-election.
