Warsaw Woman Arrested For Allegedly Strangling A Child

Elizabeth Rae Justice, 45, of 208 N. Fort Wayne Ave., Warsaw, was booked in the Kosciusko County Jail at 10:07 a.m. Monday and faces a Level 6 felony strangulation charge and a Class A misdemeanor domestic battery charge.
According to the probable cause affidavit filed Jan. 28 in Kosciusko Superior Court III, on Dec. 4 Warsaw police responded to a home to take a report of a juvenile runaway. Upon arrival, police could smell a strong odor of alcohol on Justice and her eyes appeared to be bloodshot and watery as she spoke with police, court papers state. Justice said the child had ran away and that she had taken the child’s phone away as punishment because the child had gotten expelled from school. Justice said she eventually gave the child the phone back, but that the child choked her. Police reports state there were no signs of Justice being choked.
Later that day, police were told the child was at another location requesting medics for injuries. When police arrived, the child said Justice had been drinking alcohol all day and was agitated. The child said Justice asked him to make dinner, but he refused and went to his room instead. At some point, according to the probable cause affidavit, Justice entered the child’s bedroom, jumped on him while he was lying down in his bed and choked him. The child apparently was able to take a picture of this happening with his cellphone before fleeing from the home. Police reported there were visible marks on the child that matched his story.
When police took the child back to the home to speak with Justice about the incident, court papers state that Justice changed her story several times, but admitted she put a choke hold on the child.
Her bond was set at $2,750.
